Other Delaware laws that may matter

  • Consumer protection law: Delaware Consumer Fraud Act (6 Del. C. section 2511 et seq.). It applies to businesses generally, not to chatbots specifically; whether it reaches a particular chatbot practice is a legal question.
  • Consumer privacy law: Delaware Personal Data Privacy Act (6 Del. C. ch. 12D), in effect from January 1, 2025. It sets rules for personal data, which can include what people type into a chatbot, for businesses that meet its thresholds.

What still applies

Without a state chatbot law, companies serving Delaware residents may still face other states' laws when they serve users there, general consumer protection law and federal rules. Congress is considering 13 chatbot bills; see federal bills.
