Can you get banned from ChatGPT? What OpenAI's terms say

OpenAI's terms say it may suspend or terminate accounts in certain situations, and its help center describes warnings, deactivation notices and appeals. This guide summarizes what OpenAI's own pages say as of November 5, 2026. It is not legal advice.

Updated November 5, 2026. Facts checked against the cited sources on November 5, 2026.

The short answer

Yes, according to OpenAI's own pages. As of November 5, 2026, OpenAI's Terms of Use for the rest of the world and the U.S. (effective January 1, 2026) say it may suspend or terminate access, or delete the account, if it determines you breached the terms or Usage Policies, it must act to comply with the law, or your use could cause risk or harm to OpenAI, users or anyone else.

Terms can differ by region and change over time, so check the version that applies to you.

What the terms say about suspension and termination

These points are from OpenAI's Terms of Use (rest of world and U.S. version, effective January 1, 2026).

  • Grounds: a breach of the terms or Usage Policies, a legal requirement, or use that could cause risk or harm to OpenAI, users or anyone else.
  • Inactivity: the terms say OpenAI may terminate accounts that have been inactive for over a year without a paid account, with advance notice.
  • Payment: the terms say a failed payment may lead to a downgrade or suspension of access.
  • Appeals: the terms say that if you believe an account was suspended or terminated in error, you can appeal by contacting Support.

What OpenAI's Usage Policies cover

As of November 5, 2026, OpenAI has published an updated version of its Usage Policies that takes effect November 20, 2026, with a link to the previous version. The page says breaking or circumventing the rules and safeguards may mean losing access or other penalties, and that you can appeal if you think OpenAI made a mistake in enforcing the policy.

In plain words, the updated page groups its rules under three headings.

  • Protect people: it covers threats, harassment and defamation; promoting suicide, self-harm or disordered eating; sexual violence and non-consensual intimate content; terrorism and violence; weapons; illicit activities; cyber abuse and intellectual property infringement; real-money gambling; tailored licensed advice without a professional; unsolicited safety testing; and circumventing safeguards. It also addresses national security and law-enforcement uses without review.
  • Respect privacy: it covers facial recognition databases without consent, real-time remote biometric identification in public, using a person's likeness without consent, social scoring and profiling, inferring emotions in workplaces and schools, and predicting criminal risk from personal traits.
  • Keep young people safe: it covers child sexual abuse material and child sexual exploitation, which the page says OpenAI reports to NCMEC, and exposing minors to age-inappropriate content.

Warnings, closures and temporary suspensions

As of November 5, 2026, OpenAI's help center article on account closures and safety suspensions says OpenAI may deactivate or restrict an account because of a policy violation, a security concern, repeated misuse or an incomplete verification requirement.

  • Usage Policy violations: the article lists examples such as sexual content that breaks its rules, child exploitation or abuse, content that facilitates violence or harm, content that promotes suicide or self-harm, scams, hate, harassment or spam, illegal activity and intellectual property infringement. It says discussing a sensitive topic does not by itself mean an account will be closed.
  • Terms of Use violations: examples include circumventing security controls or access restrictions, sharing an account or API keys in ways the terms don't allow, and uses that could harm others or disrupt the services.
  • Warnings: OpenAI's warning article says a warning is a notice, not an immediate suspension, and that continued violations after a warning may lead to further restrictions or permanent deactivation. The closures article says an account may be closed if the issue isn't fixed within the time the warning states.
  • Verification: the closures article says an account that doesn't complete a required identity or age verification may be deactivated or disabled until it does, and that being placed in the ChatGPT for Teens experience does not by itself deactivate an account.
  • Temporary safety suspensions: the article says that after repeated conversation endings, ChatGPT may temporarily suspend an account if further conversations raise serious concerns about violence or harm to others. You are signed out and can't use ChatGPT until the suspension ends; it says this is not by itself a permanent closure.

How appeals work

OpenAI's terms and Usage Policies both say you can appeal if you think an action was a mistake. Its closures article gives these steps:

  • Use the appeal link in the account-closure notification email.
  • If you can't access that email, submit the account closure appeal form linked from the article.
  • If you lost access but received no closure email, contact OpenAI Support through the Help Center.
  • Include your user ID and organization ID if available, information about your account activity and why you think the closure was a mistake, and any steps you took to secure your account.
  • OpenAI says requesting a review does not guarantee the account will be restored.

Age rules and accounts OpenAI believes belong to minors

OpenAI's Terms of Use (effective January 1, 2026) say you must be at least 13, or the minimum age in your country if higher, and that users under 18 need permission from a parent or legal guardian.

OpenAI said on January 20, 2026 that it was rolling out age prediction on ChatGPT consumer plans. It says the model uses signals such as account age, typical times of activity, usage patterns and the age a user stated. If it estimates a user is under 18, OpenAI says ChatGPT applies extra protections, and when age is in doubt it defaults to the under-18 experience. OpenAI says adults placed there can verify their age through Persona from Settings, then Account, then Age. Our guide to ChatGPT age verification, teen mode and adult mode covers this in more detail.

If an account is closed or disabled

OpenAI's deletion article says an email address disabled for a terms or policy violation cannot be reactivated, and that a phone number from an account disabled for a violation cannot be reused. For leaving on your own terms, see our guide to how to delete your ChatGPT account.
